1. Who we are
Eary is made and operated by NutMeg Projects, Winschoterdiep 50, 9723 AB Groningen, the Netherlands. Chamber of Commerce (KvK) 95331840, VAT NL005147009B21. You can reach us at contact@eary.ai. In these terms, “we” and “us” mean NutMeg Projects; “you” means the person using Eary.
2. What Eary is — and what it is not
Eary is a diary app. You write or speak your entries, and an AI companion listens, reflects them back and helps you notice patterns over time.
Eary is not healthcare. It does not diagnose, treat or give medical or psychological advice, and it is not a crisis service. If you are in danger or in crisis, contact your doctor, call 112, or call 113 Zelfmoordpreventie on 113 or 0800-0113 (in the Netherlands).
Eary uses AI, which can be wrong. Treat what it says as a mirror to think with, not as fact or advice.
3. Your account
You need an account, which you create with your e-mail address. You must be at least 16 years old. Keep access to your e-mail secure — anyone who can read your mail can sign in to your account. One account is for one person.
4. Free and paid plans
Writing and speaking your diary is free and unlimited, always. On top of that:
- Free. In your first two weeks: 30 exchanges with Eary and one live voice conversation of ten minutes. After that: 8 exchanges a month.
- Premium — €7.99 per month. 45 minutes of live voice conversation, 60 exchanges and 8 creations (artwork, poems, songs) a month, plus Persona and Connect.
- Supporter — €10.99 per month. Everything in Premium; €3 of each month’s payment goes to charity.
All prices are in euros and include VAT. The monthly limits are fair-use limits: they reset at the start of each calendar month and do not carry over. We may adjust the limits to keep the service sustainable; if we lower what your plan includes, we will tell you at least 30 days in advance by e-mail and you can cancel before the change takes effect.
5. Paying
Payments run through Mollie B.V., a licensed Dutch payment provider. Your first payment is made with iDEAL and also authorises a SEPA direct debit mandate. From then on, the same amount is collected automatically each month on the monthly anniversary of your first payment, until you cancel. We never see or store your bank details.
If a collection fails, Mollie retries it. If payment still does not come through, your subscription features may be paused until it does. Your diary and everything in it stays yours and stays accessible.
6. Cancelling, and your 14-day right of withdrawal
You can cancel at any time under “Your Eary account” on eary.ai, or by mailing contact@eary.ai. Cancelling stops all future collections. Your paid features stay active until the end of the month you already paid for. There is no notice period and no cancellation fee.
As a consumer you have a statutory right of withdrawal of 14 days. If you cancel within 14 days of your first payment, we refund that payment in full — just mail us and say so. This applies to your first payment; monthly renewals after that are not refunded, but you can cancel at any time to stop the next one.
7. What you write stays yours
Your entries, recordings and conversations are yours. We do not sell them, we do not publish them, and we do not use them to train AI models. We process them only to provide Eary to you, as described in our Privacy Policy. If you share something through Connect, only what you choose to share becomes visible to the person you share it with.
8. Fair use
Please do not use Eary to break the law, to harm or harass others, to impersonate someone, or to resell or automate access to the service. If you do, we may suspend or close your account. If we close your account for this reason, we refund the unused part of the month you paid for.
9. Availability and liability
We do our best to keep Eary running, but we cannot promise it is always available or free of errors — it depends in part on services we do not control. Where the law allows, our liability is limited to the amount you paid us in the three months before the problem arose. Nothing here limits liability that cannot be limited by law, including for intent or gross negligence.
10. Changes to these terms
If we change these terms in a way that matters to you, we will tell you by e-mail at least 30 days in advance. If you do not agree, you can cancel before the change takes effect.
11. Law and disputes
Dutch law applies. If we cannot solve something together, the dispute goes to the competent court in the Netherlands — this does not affect your rights as a consumer to go to the court of your own place of residence. EU consumers can also use the European ODR platform at ec.europa.eu/consumers/odr.
